Calls for Retrial in Rubiales Case Amid Accusations of Judge Bias

Spanish prosecutors have called for the annulment and re-trial of former football federation chief Luis Rubiales, following concerns over judicial impartiality. The trial, which gripped Spain and thrust Jenni Hermoso into the spotlight as a symbol against sexism, saw Rubiales fined 10,800 euros ($11,370) after being found guilty of sexual assault. The controversy stemmed from an unsolicited kiss during Spain's victory at the 2023 Women's World Cup final in Sydney, sparking widespread outrage and leading to Rubiales' resignation.

During the trial, Judge Jose Manuel Fernandez-Prieto drew attention for his brusque demeanor. He frequently interrupted and scolded participants, raising questions about his conduct. Prosecutors accused him of "unduly" preventing them from posing certain questions and ignoring crucial evidence. In a statement, prosecutors emphasized the need for the trial to be "held again by another judge not tainted, to say the least, by an appearance of bias."

The original sentence imposed on Rubiales was deemed lenient by feminist groups, who had hoped for a stronger message against macho culture in sports. Prosecutors initially sought a two-and-a-half-year prison sentence for Rubiales, aligning with broader demands for accountability in cases of sexual misconduct.

The trial has not only affected Rubiales personally but has also plunged the Spanish football federation into a prolonged period of turmoil. The backlash from the incident highlighted deep-rooted issues within sports culture, compelling many to reconsider existing norms and practices.

Jenni Hermoso, who found herself at the center of this media storm, is appealing the sentence. Her case has become emblematic of a larger fight against sexism and discrimination in sports, resonating with advocates worldwide.
