American Airlines has settled a lawsuit filed by three Black men—Alvin Jackson, Emmanuel Jean Joseph, and Xavier Veal—who were removed from a flight due to alleged racial discrimination. The incident occurred on January 5 during American Flight 832 from Phoenix to JFK in New York. An airline representative approached the men before takeoff, citing a complaint about body odor, and subsequently ordered them off the plane. However, none of the men were informed personally about having body odor, nor did they exhibit any offensive smell. The plaintiffs contend that their removal was racially motivated.
The National Association for the Advancement of Colored People (NAACP) had previously issued a travel advisory against American Airlines in October 2017, highlighting concerns about hostility towards Black passengers. Although this advisory was lifted nine months later following the airline's efforts to address these issues, the recent incident reignited scrutiny over the airline's handling of racial matters.
In response to the lawsuit filed on May 29 in the Eastern District of New York, American Airlines has taken substantive actions. The flight attendants responsible for the incident have been dismissed, and the airline has pledged to foster an inclusive environment for all customers. The terms of the settlement remain confidential, but it includes commitments from the airline to prevent future discrimination.
"American Airlines’ commitment to take concrete actions to address discrimination is a significant departure from the way public companies have historically dealt with individual race discrimination claims," said Susan Huhta, partner at Outten & Golden.
The three plaintiffs expressed satisfaction with the resolution, emphasizing their hope for broader change.
"We are very pleased that American Airlines took our complaint seriously and we hope that this never happens to Black passengers or any other people of color again," stated Alvin Jackson, Emmanuel Jean Joseph, and Xavier Veal.
"Our goal in speaking out has always been to create change. We are proud that we used our voices to make a difference in the lives of Black Americans," they further added.
American Airlines has faced criticism in recent years due to several reports of racial discrimination. The airline's current efforts reflect a commitment to rectify past injustices and ensure equitable treatment for all passengers.
"Corporations have a pressing responsibility to ensure that customers are not mistreated on account of race," asserted Michael Kirkpatrick, an attorney at Public Citizen Litigation Group.
"We are pleased to have reached a resolution that will allow these brave men to move forward with their heads held high," remarked Susan Huhta.
