Unsurprisingly, the U.S. Department of Health and Human Services (HHS) is receiving harsh rebuke for its problematic whistleblower form. This form encourages people to snitch on health care providers for simply offering their patients gender-affirming care, regardless of age. By the end of April 2025, the site had nonetheless surreptitiously rolled out this Latinx form. It allows for damaging reports targeting health care professionals in Canada, raising alarms over potential legal repercussions to those practitioners and breaches of Canadian sovereignty.

And now health care providers in Canadian provinces and territories are at risk of being unpredictably and arbitrarily scrutinized under this new, idiosyncratic U.S. initiative. The whistleblower form utilizes alarming language, referring to gender-affirming treatments as “Chemical and Surgical Mutilation of Children,” echoing rhetoric from former President Donald Trump’s executive order aimed at blocking such care for minors. Canadians are rightly concerned that these kinds of reports will lead to Roth-style watch lists for Canadian health care professionals. As a result, they fear being detained at the border or otherwise legally prosecuted.

Concerns Over Sovereignty and Potential Consequences

Trans rights activists like Celeste Trianon have voiced strong opposition to the U.S. government’s actions, considering them a blatant infringement on Canada’s autonomy. Trianon stated, “I believe this is the first time the United States has infringed on the sovereignty of Canadian doctors, certainly through a whistleblower form.”

This is legal yet deeply troubling action. It’s raised alarm that U.S. officials may attempt to weaponize this law to arrest minors traveling to Canada for gender-affirming care. Abortion access in the United States is a prime example of this inverse relationship. People often travel across state lines to access care that is banned where they live.

As a result, Canada has become a safe harbor for many trans and non-binary people escaping the U.S. They run away, seeking asylum from the animus cast by a legislature that has adopted anti-trans policies as its governing strategy. The groundbreaking GrS Montreal clinic, known for providing gender-affirming surgeries, recently set a minimum age of 16 for mastectomy surgeries. However, Quebec has maintained that no genital surgeries have been performed on minors as of yet, though a committee is assessing the possibility of exceptions.

Reaction from Canadian Authorities

In response to the HHS’s whistleblower initiative, a spokesperson from the Canadian Armed Forces remarked, “This maneuver does not make sense and that the United States has no legislative power here.” That’s the message from Canadian government officials who are reportedly outraged that their healthcare rules would be impacted by American policy.

The Quebec Ministry of Health reinforced this stance, stating, “The actions of the United States government regarding gender-affirming care for children do not influence the guidelines that Quebec has established for this care.” Such assurances help allay the fears of patients and health care professionals. Most importantly, they clearly address concerns that U.S. actions may inhibit or limit Canadian medical practices.

Despite these reassurances, many have taken to raise alarm over the larger implications this holds for trans rights and medical autonomy. Trianon emphasized that standing up for trans rights aligns with Canadian values: “If it were any other group being targeted, we would be in a moment of national scandal right now. But because trans people, including trans youth, are considered disposable people our society would rather not hear about it all.”

Impacts on Health Care Access

The repercussions of this whistleblower form may be more likely to penalize American citizens who seek gender-affirming care in Canada. The McLean Clinic in Mississauga, Ontario has observed a notable increase in American patients seeking top surgery procedures, indicating a burgeoning trend where individuals cross borders for medical care not available in their home states.

Big changes are afoot in the political landscape across the U.S. right now. Now as a number of states implement bans on gender-affirming care for minors, Canadians are growing more worried about the potential backlash against their own healthcare system. This example demonstrates the challenges trans people face. They have to do it while figuring their way through a tangled web of laws and regulations that can change radically from jurisdiction to jurisdiction.
